Bloomwise is a free editorial gardening publication run by DFK Helper LLC. We help absolute beginners pick plants that suit their space, climate, and tastes. We are not a horticulturist, a veterinarian, or a doctor, and we cannot guarantee the outcomes of any planting decision you make. By using the site you agree to these terms, including the binding arbitration clause below.

Bloomwise (the “Site”) is operated by DFK Helper LLC, a Delaware limited liability company (“we”, “us”, “our”).

These Terms of Service (the “Terms”) form a binding contract between you and DFK Helper LLC. If you do not agree to any part of these Terms, you must stop using the Site.

Bloomwise publishes editorial content about ornamental and edible plants, USDA hardiness zones, and beginner-friendly garden planning. The Site may also include affiliate links, sponsored placements clearly marked as such, and an automated chat assistant.

All content is for general information only. We do not provide horticultural, agricultural, veterinary, medical, nutritional, financial, or legal advice. The Site is not a substitute for consultation with a qualified professional.

You must be at least 13 years old to use Bloomwise. If you are between 13 and the age of majority in your jurisdiction, a parent or legal guardian must agree to these Terms on your behalf.

You may not use the Site if you are barred from doing so under any applicable law.

You agree to use Bloomwise only for lawful purposes, in line with these Terms. You agree not to:

• Scrape, mirror, or republish substantial portions of the Site without our written permission.
• Reverse engineer, decompile, or attempt to extract the source of any non-public part of the Site.
• Use automated tools to overload, disrupt, or probe the Site, the chat assistant, or our APIs.
• Submit content that is illegal, defamatory, harassing, or that infringes the rights of any other person.
• Misuse our affiliate links or attempt to capture commissions you have not earned.
• Use the Site to develop a competing product, dataset, or large language model training corpus.

Bloomwise includes an automated chat assistant (the “Plant Doctor”) that uses large language models to answer general gardening questions. The Plant Doctor is an entertainment and educational feature only. Its answers may be incomplete, outdated, or wrong.

We may rate-limit, throttle, or disable AI features at any time without notice.

Some links on Bloomwise are affiliate links. If you click an affiliate link and complete a qualifying purchase, we may earn a commission at no additional cost to you. We participate in the Amazon Services LLC Associates Program and other affiliate networks.

We disclose affiliate relationships in line with the U.S. Federal Trade Commission’s 16 CFR § 255.5 endorsement guidelines. See our affiliate disclosure for more detail.

We do not guarantee the availability, price, condition, or quality of any product linked from the Site. Prices shown on the Site may be out of date by the time you click through. The merchant, not Bloomwise, is the seller of record for any purchase you make.

If you submit content to Bloomwise (for example, a saved garden, a chat message, or feedback), you grant DFK Helper LLC a worldwide, royalty-free, non-exclusive license to use that content to operate, improve, and promote the Site. You retain ownership of your content.

You represent that you have the right to grant this license and that your content does not infringe any third party’s rights.

Bloomwise, including its design, copy, database structure, and trademarks, is owned by DFK Helper LLC and protected by U.S. and international intellectual property law. Editorial illustrations sourced from the Biodiversity Heritage Library and other public-domain collections remain in the public domain in their original form.

Nothing in these Terms grants you any license to our trademarks, logo, or brand assets.

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE OR ITS CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, ERROR-FREE, OR UNINTERRUPTED, OR THAT ANY PLANT, PRODUCT, OR PRACTICE DESCRIBED ON THE SITE IS SUITABLE FOR YOUR PARTICULAR CIRCUMSTANCES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DFK HELPER LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS, GOODWILL, OR PLANTS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THE SITE IS LIMITED TO THE GREATER OF (a) THE AMOUNTS YOU HAVE PAID TO DFK HELPER LLC IN THE TWELVE MONTHS PRIOR TO THE CLAIM, OR (b) ONE U.S. DOLLAR. THE FREE TIER OF BLOOMWISE INVOLVES NO PAYMENTS, SO THIS CAP IS ONE U.S. DOLLAR FOR ALL FREE TIER USERS.

You agree to defend, indemnify, and hold harmless DFK Helper LLC and its members, officers, employees, contractors, and service providers from any claim, demand, loss, damage, cost, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will be conducted in English and seated in Wilmington, Delaware, unless the arbitrator agrees to a different venue.

YOU AND DFK HELPER LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

If any provision of this section is found unenforceable, the remainder stays in force.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Subject to the binding arbitration clause above, the state and federal courts located in New Castle County, Delaware have exclusive jurisdiction over any matter not subject to arbitration.

We may suspend or terminate your access to the Site at any time, with or without cause, and with or without notice. Sections that by their nature should survive termination (including the no-warranty, limitation-of-liability, indemnification, arbitration, and governing-law clauses) will survive.

We may update these Terms from time to time. The “last updated” date at the top of the page reflects the most recent change. Material changes will be highlighted on the home page or via email if you have an account. Continuing to use the Site after a change means you accept the updated Terms.
